What is the Homeowners Association?
A. North
Brandon Shores Homeowners Association is a non-profit corporation duly
formed according to the laws of the State of Mississippi. The
Association is managed by the Board of Directors. The purpose of
the Association is to maintain all common areas including the community
center, lake, and entrance and govern the neighborhood according to
Covenants and Declarations, Bylaws, and Articles of Incorporation.
All owners of property located within North Brandon Shores are Members of
the Association and membership is both automatic and mandatory.

Q.
What are the Covenants and Declarations?
A. The Covenants
and Declarations is a binding legal obligation that is imposed by the
deed on each parcel of property in North Brandon Shores. All
parcels are subject to the Covenants even if the property is transferred
or sold to another person. The primary purposes of the Covenants
are to provide for the funding, use, and upkeep of the common areas as
well place restrictions on the use of properties. The Covenants
also define the roles of the homeowners association in managing the
common areas and enforcement.
The Covenants and
Declarations play a vital role in keeping our neighborhood a desirable
place to live.
On July 9, 2004,
the Covenants were amended by the requisite 2/3 vote of the members of
the Association. The Amended Covenants and Declarations can be found
on this website and were recorded at the Rankin County Chancery Court.

Q.
What are the Bylaws of the Association?
A. The
Bylaws of the Association are a set of rules adopted by the Association
that govern how meetings and business at meetings will be
conducted. The Bylaws also provide for the election of officers to
govern the Association.

Q.
What are the responsibilities of the Board of Directors?
A. The
Board of Directors is charged with governing the Association according to
the founding legal documents (Covenants, Bylaws, and Articles). The
Board members are volunteers and are not compensated in any way.
Board members are elected by the Members at the annual meetings for terms
outlined in the Bylaws.

Q.
How are the Officers elected?
A. Although
the Board members are elected by the membership, the Officers of the
Association are elected annually by the Board of Directors itself.
The officer positions include President, Vice President, Secretary, and
Treasurer.

Q.
Are there any rules in addition to those spelled out in the Covenants?
A.
Yes. The Board may make rules and regulations not expressly stated
in the Covenants that are binding on the Members. These rules may
apply to the use of the community center, lake, or architectural review
as examples. Rules passed by the Board of Directors or its agents
may further define the provisions of the Covenants or may be necessary in
areas where the Members' safety, health, and security is involved.
However, these rules may not be in violation of the Covenants.
Additional rules
pertaining to the lake, community center, and architectural review can be
found on this website on the respective page for each or by contacting
any member of the Board of Directors. Repeated refusal to abide by
the Covenants and/or rules can result in restricted access to
neighborhood amenities like the clubhouse or lake.

Q.
What is my assessment and how is the amount determined?
A. The
assessment for the fiscal year 2012-2013 is $400. An annual budget is
drafted by the Board of Directors prior to the annual meeting each
year. The budget is presented for discussion and approval at the
annual meeting. Amounts included in the budget must be sufficient
to cover the expected expenses of the Association as well as adequate
amounts for contingencies and future capital expenditures. The
amount of the assessment is determined by taking the amount of the total
annual budget and dividing that amount by the total number of
Members.

Q.
What happens if I don't pay my assessment?
A. In
accordance with the Procedures for Enforcement of Covenants and
Associated Penalties for Violation(s) of Covenants that was approved by
the Members of the NBSHOA in 2007, the board will be enforcing fines for
late payment of annual assessments as follows:
If the assessment
is not paid by July 31st, a $50 fine will be assessed against
owner.
If the assessment
is not paid by August 31st, an additional $100 fine will be
assessed against the owner.
If assessment
remains unpaid by September 1st, the owner�s outstanding
balance will be turned over to an attorney for collection at which time
owner�s use of all common areas (including clubhouse and lake) will be
suspended until the balance is cleared including all attorney fees,
outstanding assessments, and fines.�
All payments received will be applied to past due assessments
first.

Where do I get keys to the clubhouse or boat launch?
A. Keys to
the clubhouses or boat launch can be obtained from Brian Davidson at
(601) 824-3004 for $3.� Only one
key will be issued per household.

Q.
Where do I get stickers for my car or boat?
A. Stickers
are required on both sides of all boats used in North Brandon Lake as
well as all vehicles left unattended on a Common Area like the boat
launch or community center. Stickers can be obtained from Russell

Q.
How can I get involved by serving on a committee?
A. The
various committees established by the Board of Directors can be found on
the Committees page of this website. Please contact any member of
the Board to find out the status of a particular committee or what
committees need volunteers.

Q.
What kinds of improvements to my lot or home require architectural
approval?
A. The Covenants
require that all improvements "materially affecting the appearance
of any lot" should be submitted for review. This would include
lot preparation, the building of any structure, pier, garage, fence, or
outbuilding, or any change to plans or an existing structure that affects
the exterior appearance like the colors or materials. IN
GENERAL, WHEN IN DOUBT YOU SHOULD SUBMIT YOUR PLANS FOR APPROVAL.
Our covenants rely heavily on prior approval, and the criteria used by
the Architectural Committee may not be expressly stated in the Covenants
(they can be found on the Arch Review page in this website).
DO NOT expect the
Architectural Committee to relax or change the standards for approving
plans in a case where an improvement is made without prior approval.
In such a case, you may be required to modify or remove an improvement
which could cause you to incur considerable expense.
